This rule however has been eliminated by most states today. As long as the victim is not guilty of provoking the dog or trespassing, dog owners are generally liable for all bites and injuries that have been caused by their dog. In most states dog owners are responsible for injuries caused by their negligence.

After your dog has bitten someone you should not panic, but try to remain calm while controlling your dog and assisting the victim. Offer the person first aid, take them to the hospital if necessary and pay their medical bills. You need to remember that they have the right to hire an attorney and sue for medical expenses.

Take the contact information of the victim and ensure that you to stay in touch with them regularly after the incident. According to the circumstances by simply showing genuine concern for the victim you may be able to avoid litigation.
There are dog bite laws which are designed to protect the victims of unprovoked dog attacks. You may be entitled to payment for your lost wages, medical bills, injuries and suffering, in addition to miscellaneous expenses depending on the laws of the state where you live.

If you are bitten by a dog the first thing you need to do is to identify the dog and its owner. If you are unable to make identification or if it is a stray dog you will have to take painful rabies shots and will not be reimbursed for the medical treatment and other expenses. If the dog and its owner are identified you will probably avoid the rabies treatment. Ensure that you get the name and address of the dog owner and the license information of the dog.

Also you need to go back to the accident site and obtain contact information of any witnesses and take photographs of your injuries along with your bloody clothing, which will be needed as evidence if you are not able to personally negotiate with the owner of the dog and need to hire an attorney.

If you are bitten by a dog and the dog owner is not willing to accept liability you should retain the services of a dog attack attorney who will advice you on the legal aspect of your claim.
